Terms and conditions

1 OBJECTIVE

1.1 The purpose of this regulation is to define the general operating rules of the e-Learning training courses promoted by MARYOGAIR .


1.2 On the MARYOGAIR website are available the products marketed by Maria de Lurdes Abrunhosa Monteiro, headquartered at Rua Actriz Maria Matos, 1 R/C Dto 1500-022 Lisbon, with NIF 207604690 .

 

1.3 MARYOGAIR 's mission is to create quality training products, seeking to maximize people's potential and skills for the challenges of the job market.


1.4. The use of MARYOGAIR training services implies full acceptance and agreement with the terms and conditions of the service, by the Client/Trainee, which constitute a contract for the provision of training services and a training regulation.

1.5 The User may use the MARYOGAIR Website without any registration. However, some of the Site's features may be registration-dependent.


2. MARYOGAIR ONLINE PEDAGOGICAL MODEL


2.1. The MARYOGAIR   courses have their own pedagogical model. This model is guided by the appreciation of the trainee and their learning contexts that are mediated by technologies and where flexibility and autonomy in access to learning are central characteristics.


2.2. Temporal Flexibility: The trainee benefits from temporal flexibility, in which he has the possibility of accessing the contents of the courses anywhere and at any time, depending on his availability and learning pace, avoiding travel. This temporal flexibility also allows for participation and communication with the trainer at times that are most convenient for him.


2.3. Autonomy: Our pedagogical model also emphasizes the autonomy of the trainee in his learning process. That is, the trainee is responsible for taking the initiative to carry out the tasks determined by the trainers, carrying out the self-study of the contents made available on the platform.


2.4. Interactions between the various stakeholders: Training is based on interactions between trainees-trainers, trainees-trainees and trainees-pedagogical resources; All courses provide e-tutoring support.

 

3. SINGLE AND INDIVIDUAL USE


3.1. Any registration by the Customer at MARYOGAIR and their attendance at the courses implies acceptance of the regulation and the terms and conditions of the service.


3.2. The Customer acknowledges that, before registering with MARYOGAIR , he has the possibility to consult, read carefully and decide whether or not to accept the regulation and the general conditions of use.


3.3. The Customer acknowledges that the Username (Login) and Access Password are individual and non-transferable and can only be used by the Customer.


3.4. The Customer acknowledges that the Username (Login) and Access Password may not be provided or used by other individuals or entities, including entities that financed the Customer's enrollment.


3.5. All written communications sent to the Customer's email address are intended solely and exclusively for the Customer and may not be copied, reproduced, given for consultation or made available to third parties.


3.6. The Client acknowledges that all texts, images and other interactive resources made available on the MARYOGAIR Platform , within the scope of the Training, are intended solely and exclusively for the Client, so they cannot be made available to other individuals and/or entities, even if they have assumed payment of course attendance costs. However, the Client may request the invoicing of the services to third parties, responsible for the payment of the subscriptions. Invoicing data is provided by the Customer when formalizing the registration.


3.7. The Client acknowledges that all accesses and movements on MARYOGAIR platforms are monitored and recorded.

 

4. RESERVED USE OF IMAGES, TEXTS AND SERVICES


4.1. The texts, images, videos, sounds, interactive services and other materials or services provided by MARYOGAIR , hereinafter referred to as content, are intended to be used for the exclusive purpose of attending a MARYOGAIR course .


4.2. The Client may record and print the contents made available to him during the training he is attending, for learning purposes only.


4.3. The Client may not use the MARYOGAIR logo under any circumstances, even if it is within the scope of work carried out in the courses attended at MARYOGAIR .


4.4. In the case of publishing online works carried out within the scope of the courses that you attend at MARYOGAIR , and if you intend to use the name of MARYOGAIR , the Client must mention “this work was carried out by the trainee (Client name) within the scope of the course (course name) of MARYOGAIR and is the sole responsibility of its author”, thus assuming all responsibility for its content and dissemination and exempting MARYOGAIR from any responsibility.


4.5. The Customer may not transfer the contents to third parties, copy them, reproduce them or manipulate them in whole or in part, nor use the contents made available to them for commercial, advertising, self-promotion or training purposes for third parties. , even if you mention the source.


4.6. The Client also acknowledges that he cannot transfer the training contents to any entities that have paid him for the registration in the course he is attending or has attended.


4.7. All content made available on or by Maryogair is the property of MARYOGAIR and/or MARYOGAIR partner entities or individuals and may not be copied, reproduced, quoted or manipulated, in whole or in part.


4.8. The teaching resources, advice, opinions, texts, images that do not have the MARYOGAIR logo and other available information are the responsibility of the authors, whether they are trainers or the partner entities that develop them, and which are expressly indicated on the description page of each course, not conveying any official position or responsibility of MARYOGAIR , namely in terms of copyright.

 

5. RULES OF CONDUCT

5.1. The Customer accepts to be governed by rules and conduct of good manners in accordance with the uses and customs of Portugal and undertakes to address and interact with employees, trainers and other MARYOGAIR customers , in a correct and polite manner.


5.2. The customer acknowledges that MARYOGAIR reserves the right to edit or remove any messages posted on the discussion forum that jeopardize the normal functioning of the Training or that they are offensive or alien to the course contents, which may lead to suspension of use. of the online service by the trainee, if this practice is repeated or is considered serious.


5.3. The Customer acknowledges that it is prevented from:

• Posting unsolicited commercial messages (spam) in the discussion forums, or in other social interaction tools used in the training, messages unrelated to the course topics, complaints, personal requests or messages that disturb the pedagogical activities and the good training environment;
• Collect information about Customers of the service including, but not limited to, name, telephone and e-mail address, without the prior authorization of the targeted Customers and
MARYOGAIR ;
• Creating a false identity, impersonating another person or trying to deceive other
MARYOGAIR customers, trainers or employees ;
• Using offensive language, whether with employees, trainers or other Customers;
• Transmit any material that may be protected by patents, copyrights or other forms of intellectual property protection and for which you have no rights to transmit or use;
• Transmit viruses or any other type of destructive, nefarious code that may cause damage to third parties.

 

6. PUBLICATION OF COURSES


6.1. The e-learning courses are published on the MARYOGAIR website (https://www.maryogair.com) and presented by categories with a link to the technical file of each course (value, program, objectives, recipients, evaluation, duration, etc. ) and registration page.

 

7. REQUIREMENTS FOR USING THE MARYOGAIR TRAINING PLATFORM

7.1. Attendance of training courses is only possible in case of acceptance of the Training Regulation and the General Conditions of Use. In case the Client does not agree with the Training Regulation and the General Conditions of Use, he will not be able to register on the site, register or attend courses.


7.2. The use of MARYOGAIR training services implies:

• access to a computer with internet connection (mobile or fixed);
• a browser (program for browsing) such as Internet Explorer, Mozilla Firefox, Google Chrome or Apple Safari, preferably updated with the latest versions;

7.3. The Customer must have basic skills in the field of ICT (Information and Communication Technologies), necessary for the full attendance of training courses, ensuring that they have these skills at the time the course starts. The Client is responsible for situations in which the frequency of training is compromised because it is later revealed that he does not have these skills.


7.4. If you are a minor, the Client must present an authorization from their legal representatives in order to attend the training. The certification of the skills developed during the training will not be carried out if, by the end of the course, this authorization and the data required from the parent are not presented.


7.5. Before registering, the Client must ensure the existence of the necessary technical conditions to attend a certain course, namely in terms of equipment, software, skills, professional experience, academic qualifications, mastery of foreign languages, among other specifications mentioned on the description of the course you intend to attend and deliver all documents proving compliance, when applicable. Failure to meet these course-specific requirements is the sole responsibility of the Customer.


7.6. The Customer is responsible for all costs associated with the computer equipment and Internet connection, namely the costs that may be incurred to establish and use an Internet connection, as well as the costs of technical repairs and the printing of teaching materials.


7.7. The Client is responsible for the lack of technical conditions that make it suddenly impossible to attend the course, in whole or in part, such as a computer malfunction, problems with firewalls or protection systems installed, such as antivirus, Internet access, temporary internet failures, information loss, lack of disk space, loss, among others.


7.8. In the event of technical problems, such as computer malfunctions or Internet access problems, the Customer is responsible for ensuring alternatives, and MARYOGAIR   cannot be held responsible in this area.


7.9. The Client is responsible for all events of a personal and professional nature that prevent him from attending, in whole or in part, the courses for which he is enrolled, and for the dates chosen and indicated to MARYOGAIR , such as professional commitments. unexpected events, problems with family members, chronic or sudden illnesses, difficulties in accessing e-mail, loss of e-mails, loss or forgetfulness of access data or forgetting the start and end dates of the course, difficulties in keeping up with the pace or the degree of requirement of the course.


7.10. The Client is responsible for situations in which the course is not suited to their real training needs. The Client is also responsible for situations of change in their training needs or in their professional context that arise from the date on which the enrollment was made and that lead to situations where the course is not suited to their training needs.

8. ONLINE REGISTRATION PROCESS

8.1. Customers who wish to purchase a training service/product at MARYOGAIR   must fill in their details on the registration form with true information and declare that they are in a legal situation; Additionally, and in applicable cases, you must deliver, via e-mail or by attaching the following documentation to the order record: Curriculum Vitae and/or other documents in accordance with the course specifications.


8.2. The customer declares that - by accepting the general conditions of use - that the data filled in by him on the site constitutes true information only and solely to his own person.


8.3. The validation of the purchase order of one or more courses through the website www.maryogair.com assumes that the Customer has become aware of and accepts the General Conditions of Use.


8.4. After the purchase, the Customer will receive an email automatically generated through the MARYOGAIR website confirming the transaction.


8.5. If the data is not correct, the Customer may proceed or request the change of data or even cancel the purchase made.


8.6. Customer may enroll in any course as long as it meets the entry criteria, if applicable.


8.7. If the course requires entry criteria (at the qualification or experience level) in addition to the usage requirements set out in point 5.1., the trainee selection process begins with the curricular evaluation and analysis of the information contained in the form of the subscription.


8.8. After confirming that the course requirements are met, the trainees are selected on a first-come, first-served basis;


8.9. In the case of courses that have a maximum number of participants, the trainees will be selected in order of arrival of the registration formalization;


8.10. The client acknowledges that, except in the cases indicated, there is no minimum or maximum number of trainees.

 

9. PAYMENTS


9.1. The Customer acknowledges that the attendance of any training course, except for products marked as free, is dependent on full or partial payment;


9.2. The Client acknowledges that the amounts related to the use of the courses he intends to attend are duly indicated on the description pages of each course;


9.3. After registering for a course and accepting the conditions set out in these Training Regulations, the customer can make payment using one of the following means that MARYOGAIR  t at website, namely: Bank Transfer, MBWAY and PayPal.


9.4. The Customer acknowledges that all orders placed on the MARYOGAIR websitehave a validity period of 72 hours. At the end of this period, if the customer does not make the payment, he will automatically receive an electronic notification that the order has been canceled due to non-payment.


9.5. The Client acknowledges that, contrary to the previous paragraph, only in the situations of specific campaigns and promotions, the payment validity period will be until the last day of the promotional value, which date is specified on the course page.


9.6. The Customer, when completing the registration, will have to indicate the billing data and choose one of the payment methods. You must also confirm your personal data in the online registration form.


9.7. The Client is responsible for all fees charged by banks or financial institutions that he uses to make and send MARYOGAIRthe payment and the entire registration fee.


9.8. All values mentioned on the website include VAT at the legal rate in force.


9.9. After paying the registration fee, the Client acknowledges that he has reserved a place for himself and can start the course according to his availability/need, that is, he has the possibility to indicate to MARYOGAIRthe date on which he intends to start the course. (except for courses with fixed dates indicated on the website).


9.10. Payment for Advanced Training/Specializations can be made in the following ways: .

.cash payment;


9.11. The billing data entered by the customer will be used when issuing the invoice or receipt. If the Customer does not provide billing data, the invoice is issued as the final customer.


9.12. Within 24 hours after making the payment, the customer may request the change of the billing data indicated, without additional costs. After this period, requests to change billing data are subject to payment of an administrative processing fee of €10.


9.13. The Customer acknowledges that, after paying for a subscription in full, it will not be able to retroactively apply any vouchers, discounts from partner entities or other discounts.


9.14. The Client acknowledges that if he intends to take advantage of discounts from discount vouchers or discounts provided to partner entities, he will not be able to accumulate these discounts among themselves or with other promotions in force on the normal price of the course and that, before making the payment, he must send for MARYOGAIRthe vouchers, vouchers, copy of associate of partner entity or copy of document proving your relationship with the partner entity and that, if you do not do so, no discounts will be applied to you, leaving partial amounts already paid as a down payment of the inscription.
 

9.15. Once the training has started, if the Client wishes to cancel his registration, the amounts paid are not returned or credited, being considered a withdrawal, the Client losing any rights over the amounts paid.


9.16. By registering, the Client is declaring that he meets all the requirements of the course. If, during the course of the training, it is found that the Client does not meet the course requirements and, consequently, is not able to attend the course, the Client will not be entitled to any refund or postponement, even if he does not succeed in the course.

10. TRAINING ATTENDANCE CONDITIONS


10.1. To attend an e-learning course, the Customer must register on the site. After registering on the site, the Customer will receive an automatic confirmation email about the payment details.


10.2. From the moment the Client registers, and until before starting the training, the Client must indicate the date on which he intends to start the course and also complete the personal data through an online form sent by MARYOGAIR (such as the name, date of birth, etc…). These data will be used for the purpose of compiling the pedagogical dossier, registration on the distance learning platform, evaluation process and correct issuance of the professional training certificate at the end of the training.


10.3. Once the registration is complete, including payment, MARYOGAIR sends the Client, by e-mail, the access information to the distance learning platform, as well as the necessary guidelines for a good reception in the course.


10.4. After entering the platform, the Customer will have access at any time of the day or night, including weekends and holidays to their user area, courses in which they are enrolled and all supporting documentation.


10.5. Once the course has started, the Customer has access to it 24 hours a day, from the first day of the course until 23:59 on the last day of the training, applicable se_cc781905-5cde-3194-bb3b- 136bad5cf58d_ .


10.6. The general schedule of each course and the dates when classes are available depend on the course in question and vary from course to course. The duration of the course, in days/weeks, is explained on the page (site) that describes the course and from which the Customer registers.


10.7. From the moment the Client chooses/indicates the course start date, the Client acknowledges that the course end date corresponds to the total estimated duration (in weeks), made available on the website.


10.8. The Client acknowledges that the general timetable shows a duration of the training, in terms of hours, and that this duration is only an estimate of the necessary time that the Client will need to explore the contents of the classes and participate in the foreseen assessment tasks. The Client may take more or less time than estimated in a particular class or course, depending on their degree of mastery of the topics, professional experience, ease of learning and degree of adaptation to the course format, general conditions in which they are attending the course. , motivation, among other factors, and you can never blame MARYOGAIR for inconvenience or damage resulting from having had to spend more time or having completed the class or course in less time than estimated/forecast.


10.9. The detailed schedule can be found on the distance learning platform, more specifically in the private area of the course.
On the home page of the course's private area, the start and end dates of the course and/or no end date defined are indicated if  applicable . In the list of classes, the date on which each class is available is indicated. In addition, there will also be a calendar so that the Client can consult the global view of the dates of the classes that will be automatically made available. It is the Client's responsibility to monitor all the moments of the course, supported by the schedule, in order to organize themselves, in order to finish the course on time.


10.10. Customer acknowledges that the course page, which describes the objectives, program, requirements, pricing and other information, also indicates the course's working methodology. This course operation methodology varies from course to course. In particular, it is indicated whether the course is a self-learning course (without tutoring) or if it is a course with tutoring included (with support from the trainer). The pace of availability of classes is also indicated. For example, if the classes are all available right from the start, if they are available daily or every three days.


10.11. In courses with tutoring (trainer support) where classes are offered in succession – for example, one class every day or a class every three days, after the last class of the course has been made available, the schedule also includes eight extra days for the Customer to complete the training. The duration of the course included in the training plan, explained on the website, already includes these eight extra days.


10.12. During the period of the course, it is the Client's duty to attend the same, guaranteeing the completion of work proposals and assessment tests and online participation in the challenges requested by the trainers.


10.13. During the attendance of courses with a trainer, the Customer is entitled to tutoring provided by a certified trainer through the forum, with a timely response being guaranteed, within 48 hours, after posting the message;


10.14. The Client acknowledges that works delivered by mail or posted in forums other than those of the respective course will not be accepted.


10.15. The Client acknowledges that, throughout the classes, links are presented to external teaching resources that may be temporarily or permanently unavailable. In this case, the Customer acknowledges that trainers may choose not to substitute other resources, as they are irreplaceable or for other reasons. As they are complementary, optional resources or merely suggestions for future readings, they do not prevent the normal course of training.

10.16. It is the trainer's role to provide didactic resources and/or other additional support resources through the distance learning platform, correct work identifying positive points and elements for improvement; verify if the trainee performed the proposed activities and clarify doubts about the subjects.

 

10.17. The Client acknowledges that, if his/her registration has been paid for by his/her employer, he/she is entitled to be informed about the progress of his/her learning and to request an evaluation report at the end of the training.
 

10.18. The Client acknowledges that MARYOGAIR will make all possible efforts to maintain the correct functioning of the distance learning platform, seeking to guarantee its accessibility, 24 hours a day, 7 days a week. However, MARYOGAIR is not responsible for any technical failures or difficulties in operation depending on factors beyond its control and external to itself.
 

10.19. The Customer acknowledges that there may be failures in accessing the MARYOGAIR website , namely for technical updating of the website, whether planned or not, or for technical problems not attributable to MARYOGAIR   and that the Customer is only entitled to compensatory measures in case these failures last for more than 48 hours straight or interpolated along the course. These compensatory measures consist exclusively of extending the period of access to the course by twice the number of hours in which the site was unavailable, and do not entitle the customer to any financial compensation.


10.20. The Customer may request two extension periods that MARYOGAIR has available as an opportunity to complete pending assessment tasks:

• Extension of the Course up to 5 days:
During the attendance of the courses and within a maximum period of two days after the course ends, the Client may request an extension of the period of access to the course for 5 consecutive days, without incurring any cost. To take advantage of this measure, the customer must formalize his request, in writing, to the
MARYOGAIR Team .

• Extension of the Course up to 10 days:
During the attendance of the courses and within a maximum period of two days after the course ends, if the client has not been able to complete the course within the defined period and if he wants an extension of consecutive days, the client can request an extension of the period of access to the course , supporting the associated expenses of €20.00 (twenty euros). To take advantage of this measure, the customer must formalize his request, in writing, to the
MARYOGAIR.COM Team .

11. WITHDRAWALS, DELAYS AND EXCHANGES

11.1. The customer has 14 (fourteen) days to cancel the contract/course, without additional costs or the need to specify a reason.

11.2. Postponements: If the client intends to postpone the start date of the course, he must notify MARYOGAIR , and the amounts paid are retained in the company, within a period of six months, until the Client specifies the desired start date.


11.3. Exchange of courses: the customer may exchange courses, for another of equal or greater value, before the course start date or, if the course has started and provided that the course contents have not yet been accessed. If the customer wants to exchange for a course with a lower value, the difference will not be refunded, being credited to be used in future registrations, with no associated deadline.


11.4. Cancellation of Enrollment/Withdrawal: If the client wishes to cancel his enrollment in a course after having made the payment, and if the training has not started on the desired date, an administrative fee of €10 (ten euros) will be charged for each training canceled . Alternatively, and in order to avoid penalties, the amounts paid can be credited to be applied in future registrations, within a period of one year.


11.5. If the customer does not attend the course on the chosen dates, for reasons totally unrelated to MARYOGAIR , the Customer is not entitled to any refund or credit, being considered a withdrawal, losing any rights on the amounts paid.


11.6. MARYOGAIR undertakes to refund the amounts paid, in case it is unable to guarantee the functioning of the course in the conditions and dates initially foreseen, in case of cancellation of the course or the existence of courses with a minimum of trainees.


12. PROTECTION OF PERSONAL DATA

13. CUSTOMER SUPPORT AND PROCEDURES RELATING TO COMPLAINTS/COMPLAINTS AND SUGGESTIONS

13.1. The MARYOGAIR Team is available to clarify the Client on issues not directly related to the topics of the courses, such as clarification on how e-learning courses work, the registration process, the operation of the platform and the course, consultation of certificates in digital format, difficulties in accessing the course, etc.


13.2. Whenever necessary and during the training, the Client can turn to the Pedagogical Coordination of the course if he considers that there are pedagogical flaws (such as: the trainer's performance is not adequate or that the technical-pedagogical team was unable to answer correctly and clearly to his questions ). It is up to the Training Manager to articulate together with the Pedagogical Coordinator, ensuring support for training management, pedagogical monitoring of training actions and coordination with the team of trainers to ensure the proper functioning of training activities.


13.3. Complaints/suggestions may be formalized in writing and addressed to MARYOGAIR 's Management .


13.4. The procedures for action provided for the handling of complaints are as follows:

a) Analysis of the situation presented and identification of the direct actors;
b) After verifying all the information collected, reanalyze and validate or not the suggestion. In the case of a complaint, a verification process must be opened; if it is a suggestion, it will be analyzed by the technical-pedagogical team of
MARYOGAIR
to allow a decision on continuous improvement.
c) Decision
on corrective and preventive measures to be adopted;
d) Communication to the complainant: the complaint is dealt with within a maximum period of 10 working days;
e) The customer has the right to contest the decision taken within 5 working days, proceeding with the reanalysis of the process. Otherwise, the answer is considered accepted and the process will be closed.

14. ASSESSMENTS

14.1. Customer acknowledges that course evaluation criteria are specified and communicated on the page describing the course, accessible before Customer enrolls in the course.


14.2. At the opening of the course, in the first two days of the training, the Client is aware of the detailed information regarding the evaluation criteria. These evaluation criteria, as well as the way in which the final classification will be determined, will be communicated by the trainer and/or by the Technical-Pedagogical Team.


14.3. The evaluation criteria may include a set of elements from:

a) the results of the written exam assessment tests;
b) the results of the work carried out by   video   specified.

14.4. The Client acknowledges that it is his/her responsibility to read, analyze and understand how his/her learning will be evaluated throughout the course and to show initiative to comply with the evaluation criteria, in order to obtain success in the training.


14.5. The Client acknowledges that there are minimum criteria for success in the course and that they must be met, otherwise, the Client may fail for non-compliance with the minimum criteria, even if they have obtained a final average equal to or greater than 50% / 10 points. In each course, the Client can find a Checklist specially designed to support the Client in controlling/fulfilling the minimum criteria for use.


14.6. The Client acknowledges that, if he does not comment, in the first three days of the training, it is assumed that he has read, understood and has no doubts about how he will be evaluated and how his final classification will be determined.


14.7. The Client acknowledges that if they post their work or participate online within the last 48 hours of the course, feedback from the trainer is not guaranteed. Even so, all contributions made by the Client until the end of the course will be considered for evaluation purposes.


14.8. The final classification is communicated to the Customer by email,  after the completion of the exams,   within five days after the end of the course. Once this classification has been communicated, if the Client disagrees with it, he/she has the right to request, in writing, within two days, a review of his/her classification in the course, giving detailed reasons for not agreeing with it, and this reasoning must always be supported. in the evaluation criteria that were presented at the beginning of the course. At the end of this period or if the Customer wishes to request a classification review with details of its evaluation grid, it will have to bear administrative fees associated with the evaluation review processes.


14.9. In the event of disapproval, the Customer acknowledges that MARYOGAIR has remedial measures available that may benefit:

a) Within a maximum period of 8 days, after the communication of the disapproval, the Client is entitled to request an extension of the period of access to the course for 10 consecutive days in order to complete the missing evaluation elements, bearing the expenses of extension. associated.

b) In the event that the Customer has failed a course and, within three months after the course start date, the Customer may re-enter the course, upon payment of an additional 50% of the value at which the course is being marketed. at that time and if the course is available in the catalog.

14.10. Assessment is an integral and fundamental element in MARYOGAIR Training and includes the following aspects:

• Learning Assessment / Knowledge Assessment: This assessment can be qualitative or quantitative. Knowledge assessment will be carried out according to the specific objectives of each action, and for this purpose, different assessment instruments may be used, namely knowledge tests, among others;
• Satisfaction Assessment – The assessment of satisfaction/reaction to the training action, in particular with regard to the fulfillment of the proposed objectives and the technical-pedagogical level evidenced, will be carried out by completing the Training Action Assessment Questionnaire by the trainee ;
• Assessment of the Trainer's Performance – this assessment is carried out by the pedagogical coordination and will focus on the criteria of good e-tutoring practices.
• Global Assessment of Training – The Global Assessment of Training is carried out on the basis of the Training Action Assessment Questionnaire from which the Training Assessment Report is generated, which translates the assessment of each training action;
• Impact Assessment (post-training) – Online questionnaire sent to the trainee up to six months after completion of the course to assess the impact of the training.

15. ATTENDANCE STATEMENTS AND PROFESSIONAL TRAINING CERTIFICATES

1.5.1. The professional training certificate is only issued to the Customer if he/she obtains a final classification equal to or greater than 10 values (on a scale of 0-20 values), in accordance with the legal requirements in force, as well as respecting MARYOGAIR's internal rules.

15.2. The digital certificate will be issued and made available, free of charge, sent to the email of the Client/Trainee, until the 15th (fifteenth) business day after the end of the course.

15.3. The Client may request the urgent issue (within 48 hours, after the course completion date) of the certificate in digital format, at a cost of €10.00.

15.4. The Customer can request the sending of the certificate, in physical support, by sending registered mail, bearing the cost of €15.00.

15.5. The Customer can request the urgent issuance (within 48 hours) of the certificate, as well as the delivery by priority mail, bearing the urgent service fees.

15.6 In case of failure in the course, the Client may request the issuance of a declaration of attendance on letterhead and signed by the Management of MARYOGAIR .

15.7. The Customer acknowledges that a  MARYOGAIR   reserves the right to demand that it communicate data referring to identification documents, essential for the correct issuance of the professional training certificate and that the non-communication of this data may prevent the certification of the training carried out by the Customer, even if the course was successful.

15.8. If the Certificate is issued with incorrect data, due to an error attributable to MARYOGAIR , the Customer is entitled to a free reissue of a new Certificate.

15.9. The Customer acknowledges that if the certificate is issued and issued with incorrect or outdated data due to an error not attributable to  MARYOGAIR , the re-issuance of a new certificate is subject to the return of the originally issued certificate and payment of the cost certificate reissue.

15.10. Within 5 years after the course has ended, the Customer may request the issuance of a duplicate Certificate, in digital or physical support, bearing the respective service fee related to this re-issuance. The issuance of duplicates may involve updating personal data (for example, date of birth, full name, identification card data), and the Customer must notify MARYOGAIR of the new data.

15.11. The Customer acknowledges that, if it does not have a sufficiently large mailbox where the envelope containing the certificate can be placed and the postman leaves a receipt for it to be collected at a post office, and the Customer does not do so at the period, causing the certificate to be returned to  MARYOGAIR , the Customer will have to bear the costs of re-issuing the certificate and the respective postage.

15.12. The Customer acknowledges that MARYOGAIR cannot be held responsible for the Customer receiving the Certificate damaged by bad postal handling, and the Customer must complain to the company responsible for the transport, accompanied by the MARYOGAIR envelope that mentions the expression “do not fold” on the card. that was included in the envelope and demand from the transport company the payment of the costs associated with issuing a duplicate of the Certificate.


15.13. If the Customer does not have a sufficiently large mailbox where the envelope containing the Certificate can be placed and the postman leaves an acknowledgment of receipt for it to be picked up, and the Customer does not do so within the deadline causing the Certificate to be returned to MARYOGAIR , the Customer acknowledges that he will have to bear the costs of re-issuing the Certificate and the related postage. The same happens if the Customer indicates an incomplete or wrong address.

16. GENERIC DESCRIPTION OF THE TECHNICAL-PEDAGOGICAL TEAM

16.1. forming
Trainees are individuals who attend a training course, for a certain period of time, with the aim of acquiring the knowledge, skills and attitudes required for the exercise of a profession or group of professions.

Trainees' Rights:
• Receive training with quality and in accordance with the objectives, program, methodology and timetable established for the respective training action;
• Have access to the didactic resources and equipment necessary to attend the training action, depending on what is agreed for the action you attend;
• Be treated with respect and loyalty by colleagues, trainers, coordinators and other stakeholders;
• Request the support it needs to achieve the objectives;
• Receive at the end of the action, a certificate proving the attendance and/or achievement obtained;
• Participate in the evaluation of the course and the trainers, by completing the respective questionnaire;
• Submit to Maryogair any complaints, suggestions or testimonies about the training process in which they are involved;
• Demand permanent quality and compliance with the conditions that are disclosed and agreed in the present Training Regulation / Terms and Conditions of the Service.

Duties of Trainees
• Do not disturb the normal course of discussions held in the forums or group work, if any;
• Provide the knowledge assessment tests to which they will be submitted;
• Refrain from performing any act which may result in damage or discredit to
MARYOGAIR ;
• Ensure the conservation and good use of the
MARYOGAIR platform ;
• Truly inform
MARYOGAIR   of all anomalous occurrences during the training action, whether in relation to colleagues, trainers and other MARYOGAIR employees ;
• Provide all information requested by
MARYOGAIR truthfully;
• Behave in a polite and respectful manner in relationships with trainees, trainers and other Maryogair employees.

16.2. Former
Qualified individual holding specific academic and professional qualifications, whose intervention facilitates the acquisition of knowledge and/or development of skills, attitudes and forms of behavior for the trainee.


Rights of the Trainer / Entity providing Training Services:
• Have access to the results of the assessment carried out by the trainees and the Training Coordinator;
• Respond/oppose any information, assessment or complaint arising from your performance or action taken by you.

Duties of the Trainer / Entity providing Training Services:
• Develop the training that is affecting you, in terms of planning, execution and evaluation;
• Apply the general and specific objectives of the training action and prepare the respective Session/Class Plan;
• Facilitate the trainee to acquire knowledge and/or develop skills, attitudes and forms of behavior;
• Guiding the entire pedagogical course of training, as well as all situations found on the platform.
• Carry out the evaluation of the Trainees;
• Select, prepare and make available pedagogical materials to support the training action, when foreseen;
• Communicate with the Training Manager and/or the Training Coordinator any and all serious events that prevent the normal functioning of the action;
• Communicate immediately with the
MARYOGAIR teamif there is any unforeseen event that prevents you from attending the synchronous training session, if applicable;
• Attend meetings to prepare, monitor and evaluate training whenever called upon to do so;
• Truly provide all the information requested at any time;
• Refrain from the practice of any act which may result in discomfort, damage or discredit for
MARYOGAIR;
• Guide their conduct by respecting the principles of equal treatment of all agents involved in the action, abstaining from the practice of discrimination in matters of gender, ethnic-religious belonging or any other characteristic, liable to jeopardize the image of the company.

16.3. Pedagogical Coordinator / Training Manager


Pedagogical Coordinator – This is the duly qualified individual responsible for supporting the management of training and its pedagogical management, ensuring articulation between all the elements involved.

Training Manager – It is the duly qualified individual who is responsible for planning, executing, monitoring, controlling and evaluating the training activity.

Duties of the Pedagogical Coordinator / Training Manager:
• Whenever necessary, open and close courses following the procedures established for that purpose;
• Monitoring the course of training through the organization and consultation of the Technical – Pedagogical Dossier;
• Be the link between the trainee and the company;
• Ensure the proper functioning of the course, supporting the trainer and trainees in their needs, as a way of promoting a good image of Maryogair and as a contribution to the satisfaction of users and clients of the training;
• Ensures the planning, execution, monitoring, control and evaluation of the activity plan;
• Manage resources allocated to training;
• Being the interlocutor with the entities responsible for the Certification System;
• Liaise with the top managers of
MARYOGAIRand with the recipients of the training;
• Promote review and continuous improvement actions;
• Implement training quality mechanisms and guarantee the implementation of training practices, so that they are in harmony with the certification requirements.

17. GENERAL PROVISIONS


17.1. These General Conditions of Use, when accepted by the Customer, take the form of a contract concluded between the Customer and MARYOGAIR.


17.2. Other training conditions can be determined in specific and complementary contracts, the conditions of which must be considered accepted by the Customer after sending the aforementioned contract by e-mail.


17.3. MARYOGAIR reserves the right to withdraw from the contract at any time if the Customer violates, threatens to violate or demonstrates that he does not intend to comply with the Conditions set out in these Regulations, without the right to any compensatory measure or compensation.


17.4. If the Customer does not expressly communicate its acceptance of the Conditions, but continues to use the website, acceptance of the same is automatically assumed.


17.5. Even if it renounces the Terms and Conditions exposed, the Client acknowledges that it may be legally liable for violation of copyright, offenses, debts and for all consequences that may arise – directly and directly – from the misuse of the MARYOGAIR service and its contents. , rules of conduct, reserved use of texts, images and services and customer registration data remain after the end of the relationship between the Customer and MARYOGAIR.


17.6. These terms and conditions are governed by and construed in accordance with the laws of Maryogair and you irrevocably submit to the exclusive jurisdiction of the courts in that state or locality.


17.7. Any doubts regarding the provisions contained in these Regulations may be clarified with the Team, via the Internet to the email address maryogair@gmail.com


17.8. Any situation that is omitted in the present regulation will be interpreted by the MARYOGAIR Team.


17.9. All trainees, trainers and other participants in the training have the right to consult this regulation.
